Terms of Service

Version 0.1-draft · Effective: (not yet in effect — draft for counsel review) · For landlords, property managers and their team members

Draft for legal review. Not yet in effect.

These terms are an agreement between you and Tenant Yield ("Tenant Yield", "we", "us"). They apply when you create an account, invite someone to it, or use the software at app.tenantyield.com. By creating an account or accepting an invitation you agree to them. If you are accepting on behalf of a company or trust, you confirm you may bind it.

1. What Tenant Yield is

Tenant Yield is software for managing rental property: properties, units, leases, tenants, rent, maintenance, documents, books and reports. It is a tool. It is not a property manager, a bank, a money transmitter, a law firm or an accountant, and it is not a party to any lease between you and your tenants. Decisions about your properties, your tenants and your money are yours.

2. Your account and your team

  • You are responsible for the accuracy of what you enter and for the people you invite. Each member has a role (owner, admin, manager, accountant, viewer) that limits what they can do; you choose the role.
  • Owners and admins control money, settings and people. Managers run the day to day. You accept that anyone you invite as owner or admin can act for the account within those limits.
  • Keep your sign-in private. Tell us at once if you think it has been used without your permission.

3. Your data

  • Your account's data belongs to you. We store it to run the service, and we keep every account's data separate from every other account's.
  • You can export your books and download your documents at any time from Reports and Documents.
  • Our Privacy Policy explains what we collect and why. It is part of these terms.

4. Online rent collection

If you connect a Stripe account to collect rent online:

  • Payments are processed by Stripe under Stripe's terms, including the Stripe Connected Account Agreement you accept during Stripe's onboarding. Funds move from the tenant to your Stripe account and then to your bank. Tenant Yield never holds your money.
  • Tenants who pay by card pay Tenant Yield a convenience fee, currently 3% of the amount paid, shown to them before they confirm and on their receipt. This is Tenant Yield's charge for its service, not a charge by you, and it is not added to what you receive: your payout is the rent in full. Bank transfers carry no fee to the tenant or to you.
  • Refunds, disputes and chargebacks follow Stripe's rules. A disputed payment can be reversed by the card network; the amount comes out of the payment's destination and the platform's balance as Stripe determines, and Tenant Yield will show the reversal in your books.
  • You are responsible for complying with the laws that apply to your rental business, including those about accepting rent, late fees, security deposits and notices in your state.

5. Automatic charges, reminders and notices

Tenant Yield can post rent charges, assess late fees, send reminders and draft AutoPay payments on a schedule you configure. You are responsible for the settings you choose (grace days, late-fee amounts, proration, reminder timing) and for confirming they match your leases and local law.

6. Fees for the service

[to be completed by counsel]

7. Acceptable use

Do not use Tenant Yield to break the law, to discriminate against applicants or tenants in ways the law prohibits, to send unsolicited messages, or to attempt to access another account's data. We may suspend an account that does.

8. Availability and changes

We work to keep the service available, but it is provided "as is" and may be interrupted for maintenance or reasons outside our control. We may change the service and these terms; when the terms change in substance we will ask you to accept the new version on your next sign-in, and the version and date appear at the top of this page.

9. Limits on liability

To the extent the law allows, Tenant Yield is not liable for indirect or consequential losses, and our total liability to you for any claim is limited to the fees you paid us in the twelve months before the claim. Nothing in these terms limits liability that cannot be limited by law.

10. Ending the agreement

You can close your account at any time from Settings; export what you need first. We can end the agreement on notice if you breach it. Sections 3, 9 and 11 survive.

11. Governing law and disputes

[to be completed by counsel]
